Saudi Arabia Probation, Termination, and Labour Law Obligations

Saudi Arabia’s termination framework is specific and actively enforced. Understanding it before hiring, not after a dispute arises, is essential.

Probation: Saudi Labour Law allows a probation period of up to 90 days, extendable to 180 days by mutual written agreement. Either party may terminate during probation without prior notice unless the employment contract specifies otherwise.

Post-Probation Termination: Written notice is required as per contract terms typically 30 to 60 days. Termination without documented justification exposes the employer to arbitrary dismissal claims under Saudi Labour Law Article 74.

End-of-Service Award: Employees with two or more years of service are entitled to end-of-service benefits. Half a month’s salary per year for the first five years. One month per year thereafter. We calculate and accrue this from the first month under our global employer of record platform.

Annual Leave: 21 days per year for the first five years of service. 30 days per year thereafter. Maternity leave is 10 weeks fully paid. All entitlements are tracked by us from day one.

Nitaqat categorises Saudi employers into bands Platinum, Green, Yellow, Red based on the percentage of Saudi nationals in the workforce.
